MyRecco Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the MyRecco mobile application ("App") provided by Coastal Code Stack, LLC ("we," "our," or "us"). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

MyRecco is a social recommendation platform for iOS that allows users to:

• Create, save, and share personal recommendations across categories including books, movies, TV shows, restaurants, locations, music, apps, products, services, activities, live events, and other categories
• Enrich recommendations with details such as ratings, notes, location data, book information, movie and TV metadata, streaming platform information, and links
• Upload, attach, and share images related to recommendations
• Connect with other people by adding friends and following other users
• Discover, browse, and search recommendations from friends and the broader community
• Interact with recommendations by liking, commenting on, and sharing them, including sharing recommendations directly with other users inside the app
• Control the visibility of their content through privacy settings

Limited browsing of public content may be available without an account ("guest" use). Some features, including creating recommendations and social interactions, require a registered account.

3. User Accounts

3.1 Account Creation

• You must be at least 13 years old to create an account
• You must provide accurate, current, and complete information
• You are responsible for maintaining the security of your account credentials
• You may not share your account with others or allow others to access your account

3.2 Account Responsibilities

• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account
• You may not use another user's account without permission
• We reserve the right to suspend or terminate accounts that violate these Terms

4. User Content and Conduct

4.1 Content Standards

You agree not to post, upload, or share content that:

• Is illegal, harmful, threatening, abusive, or defamatory
• Infringes on intellectual property rights or privacy rights
• Contains spam, malware, or other malicious code
• Is sexually explicit, violent, or inappropriate for general audiences
• Promotes discrimination, harassment, or hate speech
• Contains personal information of others without consent
• Impersonates another person or entity

4.2 Content Ownership

• You retain ownership of content you create and share
• By posting content, you grant us a license to display and distribute it within the App
• You represent that you have the right to share all content you post
• You are responsible for ensuring your content does not violate third-party rights

4.3 Content Moderation and Reporting

• We reserve the right to review, edit, or remove content that violates these Terms
• We may suspend or terminate accounts for repeated violations
• Users can report inappropriate content through the app's reporting feature
• 24-Hour Response Commitment: We commit to reviewing and acting on all content reports within 24 hours of submission
• Zero Tolerance Policy: We have zero tolerance for objectionable content, harassment, or abusive behavior
• Immediate Action: When objectionable content is confirmed, we will immediately remove the content and may suspend or terminate the user account
• User Blocking: Users can block other users who engage in abusive behavior

5. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6. User-Generated Content Safety and Moderation

6.1 Our Commitment to Safety

We are committed to maintaining a safe and respectful environment for all users. Our content moderation policies are designed to protect users from harmful or inappropriate content.

6.2 24-Hour Response Commitment

We commit to reviewing and acting on all content reports within 24 hours of submission. This commitment applies to:

• Reports of inappropriate or objectionable content
• Reports of harassment or abusive behavior
• Reports of spam or misleading content
• Reports of fake accounts or impersonation
• Any other violations of our community guidelines

6.3 Zero Tolerance Policy

We have a zero-tolerance policy for:

• Objectionable, harmful, or inappropriate content
• Harassment, bullying, or abusive behavior
• Hate speech or discrimination
• Sexually explicit or violent content
• Spam, scams, or misleading information
• Impersonation or fake accounts

6.4 Enforcement Actions

When violations are confirmed, we will take immediate action:

• Content Removal: Immediately remove objectionable content
• Account Suspension: Temporarily suspend accounts for violations
• Account Termination: Permanently ban accounts for serious or repeated violations
• Legal Action: Report illegal activity to appropriate authorities

6.5 User Protection Features

We provide users with tools to protect themselves:

• Report Feature: Built-in reporting system for inappropriate content
• User Blocking: Ability to block users who engage in abusive behavior
• Privacy Controls: Control who can see your content

6.6 Appeal Process

Users may appeal moderation actions:

• Contact us within 30 days of the action
• Provide additional context or evidence
• We will review appeals within 7 days
• Decisions are final and binding

7. Third-Party Services and APIs

7.1 OpenLibrary Integration

• We integrate with the OpenLibrary API (Internet Archive) to provide book information
• Book data is provided by OpenLibrary and subject to their terms of service
• We are not responsible for the accuracy or availability of OpenLibrary data
• Users must comply with OpenLibrary's terms when using book features

7.2 Other Third-Party Services

• We use Firebase (Google) for authentication, database, and storage services
• Apple Sign-In is available for authentication on iOS devices
• These services have their own terms of service and privacy policies

8. Intellectual Property

8.1 Our Rights

• The App, including its design, code, and branding, is owned by Coastal Code Stack, LLC
• You may not copy, modify, distribute, or reverse engineer the App
• You may not use our trademarks or branding without permission

8.2 Your Rights

• You retain ownership of content you create
• You grant us a license to use your content to provide the service
• You may remove your content at any time

9. Prohibited Uses

You agree not to use the App to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to our systems
• Use automated tools to scrape or collect data
• Interfere with the proper functioning of the App
• Distribute malware or other harmful code
• Engage in commercial activities without our permission

10. Disclaimers and Limitations

10.1 Service Availability

• The App is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We may modify, suspend, or discontinue the App at any time
• We are not responsible for data loss or service interruptions

10.2 Content Accuracy

• We do not verify the accuracy of user-generated content
• Users are responsible for the accuracy of their recommendations
• We are not liable for any damages resulting from inaccurate content

10.3 Limitation of Liability

To the maximum extent permitted by law, Coastal Code Stack, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

11. Indemnification

You agree to indemnify and hold harmless Coastal Code Stack, LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Termination

12.1 Your Right to Terminate

• You may delete your account at any time
• Account deletion will remove your profile and content
• Some data may be retained for legal or security purposes

12.2 Our Right to Terminate

• We may suspend or terminate your account for violations of these Terms
• We may terminate service with reasonable notice
• Termination does not affect your obligations under these Terms

13. Governing Law, Mandatory Arbitration, and Dispute Resolution

This Policy and Use of the Application shall be governed by, and construed, and enforced in accordance with the laws of the State of Florida, without regard to conflicts of law principles thereof or of any other jurisdiction that would require the application of another jurisdiction. All claims arising out of the interpretation, application or enforcement or otherwise relating to the subject matter, of this Policy and Use of the Application, shall be settled by final and binding arbitration in Volusia County, Florida, in accordance with the commercial rules then prevailing of the American Arbitration Association by one arbitrator appointed by the American Arbitration Association. The decision of the arbitrator shall be binding on all parties and may be entered and enforced in any court of competent jurisdiction by either party. The arbitration shall be pursued and brought to conclusion as rapidly as possible. TO THE EXTENT PERMITTED BY LAW, EACH PARTY VOLUNTARILY AND IRREVOCABLY WAIVES ALL RIGHT TO TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM (WHETHER BASED UPON CONTRACT, TORT OR OTHERWISE) RELATED TO OR ARISING OUT OF THIS POLICY OR USE OF THE APPLICATION.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated terms in the App
• Updating the "Effective Date" at the top of these terms
• Sending email notifications for significant changes

Your continued use of the App after changes constitutes acceptance of the new terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Coastal Code Stack, LLC regarding the App.
